Introduction
These Terms of Service govern your access to and use of MyKalt’s mobile application, website and related services (together, the “Services”). Please read them carefully before creating an account or using the Services. By accessing or using the Services, you agree to be bound by these Terms and our applicable policies. If you do not agree, do not use the Services.
“MyKalt”, “we”, “us” and “our” mean Kalt Technologies Limited, trading as MyKalt. “You” and “your” mean the individual or entity using the Services. These Terms should be read with our Privacy Policy, Cookies Policy, KYC Policy and AML, CFT and CPF Policy.
1. Eligibility and account registration
You may use the Services only if you have the legal capacity to enter into these Terms, meet the applicable age requirement in your jurisdiction, and may lawfully use the Services where you are located. You must provide accurate, complete and current information, keep your account credentials secure, and promptly notify us of suspected unauthorised access or security compromise.
You are responsible for activity carried out through your account unless applicable law provides otherwise. We may refuse an application, require additional information, or limit account functionality where this is reasonably necessary for security, compliance, fraud prevention or legal reasons.
2. Verification and compliance
We may require identity verification, customer due diligence and other information before or during your use of particular Services. You must provide only information and documents you are authorised to provide. We may delay, decline, restrict or suspend a transaction or account where verification cannot be completed, information appears unreliable, or a legal, regulatory, security or financial-crime concern arises.
Our approach to verification and financial-crime risk is described in the KYC Policy and AML, CFT and CPF Policy. We do not disclose confidential compliance procedures, reviews or communications with competent authorities except where disclosure is permitted or required by law.
3. Digital assets, transactions and third-party services
The availability of digital assets, networks, quotations, fees, limits, payment methods and other features may vary. You are responsible for reviewing the information displayed to you before confirming a transaction, including the asset, amount, network, destination address, fees and any applicable exchange rate.
Some instructions may be final once submitted or confirmed. You are responsible for checking the details of an instruction before you confirm it. Independent third-party services may experience delays, outages, restrictions or failures that affect the Services, and MyKalt does not control those third-party systems.
4. Pricing, fees and taxes
Applicable prices, exchange rates, spreads, fees and limits will be displayed, communicated or otherwise made available for the relevant Service. They may change before a transaction is confirmed. You are responsible for any taxes, levies or reporting obligations that apply to your use of the Services, except where applicable law requires otherwise.
5. Your responsibilities and prohibited use
You must use the Services lawfully and responsibly. You must not use the Services to commit or facilitate fraud, money laundering, terrorist financing, proliferation financing, sanctions evasion, market abuse, unauthorised access, identity theft, deception, or any other unlawful activity.
You must not interfere with the security, availability or integrity of the Services; attempt to access another person’s account; use false or misleading information; introduce malicious code; reverse engineer the Services except where law expressly permits it; or use the Services in a way that infringes another person’s rights.
6. Suspension, restriction and closure
We may suspend, restrict, delay, decline or close an account or transaction where reasonably necessary to protect customers, comply with law, manage risk, investigate suspected misconduct, respond to a lawful request, or protect the integrity of the Services. Where appropriate and permitted, we will communicate the reason for an action; however, we may be unable to do so where disclosure would be unlawful or could compromise a review or investigation.
You may request closure of your account, subject to outstanding obligations, security checks and record-retention requirements. Closure does not automatically require immediate deletion of records that we must or may lawfully retain.
7. Risk disclosure and no advice
Digital assets can be volatile and may lose value. Past performance does not predict future results. Information made available through the Services is provided for general information only and is not investment, legal, tax, accounting or financial advice. You are responsible for assessing whether a transaction is appropriate for you and should obtain independent professional advice where necessary.
8. Privacy, data protection and communications
We process personal information in accordance with our Privacy Policy and applicable data-protection requirements, including the Nigeria Data Protection Act 2023 where applicable. You agree that we may send service, security, transaction and legally required communications to you. Marketing communications are subject to your preferences and applicable law.
9. Intellectual property
The Services, including their content, branding, software, designs and materials, are owned by or licensed to MyKalt and are protected by applicable intellectual-property laws. Subject to these Terms, we grant you a limited, personal, revocable, non-transferable and non-exclusive right to use the Services for their intended purpose.
10. Disclaimers and limitation of liability
To the maximum extent permitted by applicable law, the Services are provided on an “as available” basis. We do not guarantee uninterrupted availability, error-free operation, a particular outcome, a particular price, or the availability of a third-party service. Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited.
To the maximum extent permitted by applicable law, MyKalt is not liable for losses arising from changes in value, incorrect transaction instructions, loss of access caused by your failure to protect credentials, third-party failures, or events outside our reasonable control.
11. Changes, governing law and contact
We may update these Terms to reflect changes in the Services, law, regulation, security or our operations. Where required, we will provide notice through the Services or by another reasonable method. Continued use after the effective date of an update constitutes acceptance of the updated Terms to the extent permitted by law.
